Terms of Service

These terms cover your use of Count and its related account and sync services, provided by James Storer ("we", "us" or "our"). You can contact us at james@jamesstorer.com.

Please read these terms before using Count. They describe the service we provide and your responsibilities when using it. Your mandatory consumer rights apply regardless of anything in these terms.

Using Count

Count helps you create countdowns and count-ups, save moments, import calendar events, and display reminders and widgets on supported Apple devices. You can use its local features without creating a Count account. Some features require internet access, optional permissions, a compatible third-party account or Count Plus.

You must be legally able to enter into an agreement to use the service, or have the permission and supervision of a parent or guardian where required by the law that applies to you. You must also meet the requirements of the Apple or Google services you choose to use.

Apple app licence

Your licence to use the Count app is governed by the Apple Standard End User Licence Agreement. These terms supplement that licence for Count's account and related services; they do not replace it. If there is a conflict concerning the app licence, Apple's standard agreement applies. Apple’s purchase and platform terms also apply when you use the App Store.

Your account

Optional accounts use Sign in with Apple or Google. Keep your provider account secure and contact us if you suspect someone has accessed your Count account without permission. Do not access another person's account without their permission or misrepresent your identity.

Use the same provider and account on each device to access your synced moments. Accounts created through different sign-in providers are not automatically combined, even if their email addresses match.

Your moments and content

You retain ownership of the photos, notes and other content you add to Count. You must have the rights or permissions needed to use that content, including information about other people and events from shared calendars.

You give us a limited, non-exclusive permission to store, copy, transmit, resize and display your content only as needed to operate the features you request, such as syncing photos and displaying widgets. We may use our service providers for those purposes. This permission does not allow us to sell your content or use it in advertising. It lasts only as needed to provide those features and handle the storage and deletion processes described in our privacy policy.

If you choose to share a moment, you are responsible for the content and recipients you select. Keep separate copies of original photos and information you cannot afford to lose: Count resizes selected photos and is not an archival backup service. This does not reduce our responsibility to provide the service with reasonable care and skill.

Acceptable use

You must not use Count to break the law, infringe another person's rights, distribute malicious software, gain unauthorised access to systems or data, disrupt the service, or evade purchase verification or reasonable security and storage controls. These restrictions do not limit activities that applicable law expressly permits.

Count's app design, software, branding and supplied artwork remain owned by us or their respective licensors. Your ownership of your own content is unaffected.

Count Plus and payments

Count currently includes up to five saved moments for free. Count Plus adds unlimited saved moments, additional styles, collections and custom reminders. Unlimited moments means the five-moment product limit is removed; reasonable technical limits on uploads, storage and sync requests still apply.

Available plans, prices, billing periods and any eligible introductory offers are shown in the app and Apple's purchase confirmation before you buy. Apple processes payments using your Apple Account. We do not receive your payment card details.

Monthly and yearly subscriptions renew automatically unless you cancel through Apple. To avoid the next renewal charge, cancel at least 24 hours before the current period ends, as described in Apple's purchase terms. Cancellation normally leaves access available until the end of the paid period, subject to refunds or other adjustments made by Apple.

If Apple offers you a free trial, its duration, eligibility and subsequent subscription price will be shown before confirmation. Unless cancelled in time, it converts to the paid subscription shown. Apple determines eligibility and the effect of cancellation on trial access; do not assume that trial access continues after cancellation.

The lifetime plan is a one-time, non-consumable purchase with no recurring subscription charge. It provides continuing access to the Count Plus features included in that purchase while Count remains available and compatible with your device. It does not promise that the app, cloud service or compatibility with every future operating system will continue indefinitely. This does not permit us to disregard the benefits advertised at purchase or your statutory remedies if the service changes or ends.

Manage or cancel subscriptions in Settings → your name → Subscriptions → Count on your device, or use You → Manage subscription when available in Count. Restore eligible purchases through You → Restore purchases, using the Apple Account that made the purchase. If you also have an active subscription when buying lifetime access, manage that subscription separately through Apple.

Deleting the app or your Count account does not cancel an Apple subscription. Refund requests can be made through Apple's Report a Problem service. Apple's processes do not remove any refund or other rights you have under applicable law. Future price changes will follow Apple's notification and consent requirements and applicable law.

Calendars, reminders and availability

Calendar connections are optional and read-only. Count saves the events you select and refreshes supported imported titles and dates while the app is open. Removing an event from its original calendar does not automatically remove its saved moment from Count.

Calendar and account sync depend on connectivity, permissions and the availability of external services. Apple controls widget refresh timing and notification delivery. Open Count periodically to renew reminders for recurring moments, and independently check dates and deadlines where missing them could cause harm or significant loss.

We will provide Count with reasonable care and skill, but cannot promise uninterrupted availability or compatibility with every device or external service. Maintenance, faults and changes to Apple or Google services may affect features. We will take reasonable steps to address problems within our control.

Privacy and deletion

Our Privacy Policy explains the information Count handles, service providers, retention and your rights. It describes data processing rather than requiring blanket consent to all processing.

You can stop using Count at any time and delete your account through You → Delete account while signed in. Account deletion removes your account and associated data from the live Count service. Individual moment deletion retains its record and attached content for sync; signing out or deleting an account can leave archived copies on devices. Backups and other retention are explained in the privacy policy. Contact us if you cannot access your account or need help with a deletion request.

Suspension and service changes

We may restrict account or service access when reasonably necessary to address a serious breach of these terms, a security threat or a legal requirement. Where practicable, we will explain the reason and allow you to resolve the issue before restricting access. Immediate action may be necessary to protect people or systems. You can contact us to ask for a review of a restriction.

We may update Count to fix problems, improve features or meet legal and platform requirements. If we plan to discontinue the service or make a change that materially reduces a paid benefit, we will give reasonable advance notice where practicable and explain the options available, including any cancellation or refund rights. We will not use these terms to remove statutory rights or retrospectively withdraw benefits owed for an existing purchase.

Responsibility and consumer rights

We are responsible for loss or damage that is a foreseeable result of our breach of these terms or failure to use reasonable care and skill. We are not responsible for losses that were not reasonably foreseeable or that were caused by your breach of these terms, except where applicable law provides otherwise.

Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any liability or consumer right that cannot lawfully be excluded or limited. This includes applicable rights relating to faulty digital content and services. We do not require you to waive those rights or agree to mandatory arbitration.

Changes to these terms and questions

We may revise these terms to reflect service changes or legal requirements. We will update the date on this page and give reasonable notice of material changes where required. Changes will not apply retrospectively to disputes or remove rights already attached to purchases. Where a change requires your agreement, we will seek it.
